Order made by the Secretary of State, laid before Parliament under section 67(5) of the Police and Criminal Evidence Act 1984 for approval by resolution of each House of Parliament

POLICE

The Police and Criminal Evidence Act 1984 (Codes of Practice) Order 1988

Whereas —
    (1)  in pursuance of section 60(1)(a) of the Police and Criminal Evidence Act 1984^[1] (hereinafter referred to as "the Act" ) the Secretary of State is under a duty to issue a code of practice in connection with the tape-recording of interviews of persons suspected of the commission of criminal offences which are held by police officers at police stations:

    (2)  in pursuance of section 67(1) of the Act the Secretary of State has prepared and published a draft code of practice in connection with the said matter and has considered representations made to him thereon:

    (3)  in pursuance of section 67(3) of the Act the Secretary of State has laid a draft of the code of practice before both Houses of Parliament:

Now, therefore, the Secretary of State, in exercise of the powers conferred on him by section 67(4) of the Act, hereby orders as follows:

Citation and Commencement
    1.    This Order may be cited as the Police and Criminal Evidence Act 1984 (Codes of Practice) Order 1988 and shall come into force on the day after the day on which it is approved by resolution of each House of Parliament.

Tape-recording code of practice
    2.    The code of practice laid in draft before Parliament on 13th June 1988 in connection with the tape-recording of interviews of persons suspected of the commission of criminal offences which are held by police officers at police stations shall come into operation on the day after the day on which this Order is approved by resolution of each House of Parliament.

This order appoints as the date on which the code of practice for the tape-recording of police interviews under section 60(1) of the Police and Criminal Evidence Act 1984 will come into operation.

When the code is in operation, it will apply to the tape-recording of police interviews in any area where tape-recording is required by virtue of an order under section 60(1)(b) of the Act of 1984. (By virtue of section 121(1) and (2) of that Act, section 60(1)(b) may be brought into force for different areas on different dates.)

The code of practice will be published by Her Majesty's Stationery Office: copies may be obtained from Government bookshops.
