NORTHERN IRELAND

The Road Vehicles (Registration and Licensing) (Amendment) Regulations (Northern Ireland) 1988

Coming into force 1st August 1988

    The Secretary of State for Transport, in exercise of the powers conferred by sections 12(1) and 34(1) and (2) of the Vehicles (Excise) Act (Northern Ireland) 1972[1] and now vested in him [2] , and of all other enabling powers, hereby makes the following Regulations:—
    Citation and commencement
        1.    These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) Regulations (Northern Ireland) 1988 and shall come into force on 1st August 1988.
    Interpretation
        2.    In these Regulations "the 1981 Order" means the Road Traffic (Northern Ireland) Order 1981[3] .
    Amendment of Regulations
        3.    The Road Vehicles (Registration and Licensing) Regulations (Northern Ireland) 1973[4] shall be further amended in accordance with these Regulations.
        4.    For regulation 4 (application for licences) there shall be substituted —
            "4.—(1)  A person who keeps a mechanically propelled vehicle and who desires to obtain a licence for it under the Act may apply to the Secretary of State by means of a declaration in the prescribed form not more than 14 days before the licence is to have effect.

            (2)  The application shall be accompanied by —
          (i) the amount of duty, if any, payable on the licence under the Act in respect of the vehicle;
          (ii) where a registration book has been issued in respect of a vehicle, the registration book, or, if the registration book cannot be produced, an application in accordance with regulation 7(1A) for the issue of a new registration book;
          (iii) a certificate of insurance where required under Part VIII of the 1981 Order or a valid insurance card as defined in regulation 3 of the Motor Vehicles (International Motor Insurance Card) (Northern Ireland) Regulations 1969[5] ;
          (iv) in the case of a public service vehicle, a public service vehicle licence required under Article 60(1) of the 1981 Order;
          (v) in the case of a goods vehicle, a goods vehicle certificate where required under Article 53 of the 1981 Order;
          (vi) in the case of a large private passenger vehicle, a certificate of inspection where required under Article 67 of the 1981 Order; or
          (vii) in the case of any other vehicle, a vehicle test certificate where required under Article 34 of the 1981 Order.

            (3)  An application to a Post Office for a licence in the circumstances described in the proviso to regulation 17(1) may not be made after the expiration of 14 days from the date on which the licence expires." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations consolidate and amend regulation 4 of the Road Vehicles (Registration and Licensing) Regulations (Northern Ireland) 1973. By virtue of the amendments additional documents are required to be produced with an application for a vehicle excise licence under the Vehicles (Excise) Act (Northern Ireland) 1972.
    The additional documents are —
      (i) in the case of a public service vehicle, a public service vehicle licence required under Article 60(1) of the Road Traffic (Northern Ireland) Order 1981 ("the 1981 Order" );
      (ii) in the case of a goods vehicle, a goods vehicle certificate where required under Article 53 of the 1981 Order; or
      (iii) in the case of a large private passenger vehicle, a certificate of inspection where required under Article 67 of the 1981 Order.
