AGRICULTURE

The Intervention Functions (Delegation) (Amendment) Regulations 1988

    The Minister of Agriculture, Fisheries and Food, the Secretaries of State respectively concerned with agriculture in Scotland and Northern Ireland and the Secretary of State for Wales, acting jointly in exercise of powers conferred by section 6(2)(a) of the European Communities Act 1972[1] and now vested in them[2], and of all other powers enabling them in that behalf, and after consultation in accordance with the said section 6(2)(a) with the Home-Grown Cereals Authority, hereby make the following Regulations:—
    Title and commencement
        1.    These Regulations may be cited as the Intervention Functions (Delegation) (Amendment) Regulations 1988 and shall come into force on 1st July 1988.
    Amendment of the Intervention Functions (Delegation) Regulations 1972
        2.    The Intervention Functions (Delegation) Regulations 1972[3] are hereby amended —
       (a) by the insertion in regulation 1(3) of the following definition after the definition of "the Board":—""cereals" means cereals referred to in article 1(a) and (b) of Council Regulation (EEC) No. 2727/75 on the common organisation of the market in cereals[4], as amended[5], produced in the Community;"; and
       (b) by the substitution for regulation 2 of the following regulation:—
        "  2.  The Authority shall have power to carry out in the United Kingdom such of the Board's functions with respect to cereals and oilseed rape as the Board may with the approval of the Ministers and the agreement of the Authority delegate to the Authority in writing." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Intervention Functions (Delegation) Regulations 1972 so as to extend the range of crops in respect of which the Home-Grown Cereals Authority is empowered to carry out functions on behalf of the Intervention Board for Agricultural Produce.
