PUBLIC PASSENGER VEHICLES

The Public Service Vehicles (Drivers' Licences) (Amendment) Regulations 1988

Coming into force 27th June 1988

    The Secretary of State for Transport, in exercise of the powers conferred by sections 52(1)(b)(ii) and 60 of the Public Passenger Vehicles Act 1981[1] , and of all other enabling powers, and after consultation with representative organisations in accordance with section 61(2) of that Act[2] , hereby makes the following Regulations:
        1.    These Regulations may be cited as the Public Service Vehicles (Drivers' Licences) (Amendment) Regulations 1988 and shall come into force on 27th June 1988.
        2.    Regulation 10 (Fees for tests and the provision of facilities) of the Public Service Vehicles (Drivers' Licences) Regulations 1985[3] shall be amended—
       (a) in paragraph (2) by the substitution for "£40" of "£42" , and
       (b) in paragraph (3)(c) by the substitution for the word "three" of the word "ten" .
        3.    Regulation 2(b) of these Regulations shall not apply in respect of the cancellation of an appointment made before 27th June 1988.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations further amend paragraph (2) of regulation 10 of the Public Service Vehicles (Drivers' Licences) Regulations 1985 by increasing the fee, for the provision by a traffic commissioner of facilities for an applicant for a licence to drive a public service vehicle to undergo a test, from £40 to £42.
    Paragraph 3 of that regulation (which specifies the circumstances in which a test fee will be repaid) is amended so that on and after 27th June 1988 notice of the withdrawal of an application must be received at least ten clear days (rather than three as previously) before the day on which it has been arranged to provide facilities for the test, if the fee is to be repaid. The three day notice period will remain in respect of appointments made before that date.
