The Gipsy Encampments (Metropolitan Borough of Gateshead) Order 1988

Made 29th March 1988
Laid before Parliament 13th April 1988
Coming into force 4th May 1988

    The Secretary of State, being satisfied that adequate provision is made in the area of the Metropolitan Borough of Gateshead for the accommodation of gipsies residing in or resorting to that area, on the application of the council of the Metropolitan Borough of Gateshead, and in exercise of the powers conferred by section 12(1) of the Caravan Sites Act 1968[1] , and now vested in him[2] , and of all other powers enabling him in that behalf, hereby makes the following Order:—
        1.    This Order may be cited as the Gipsy Encampments (Metropolitan Borough of Gateshead) Order 1988 and shall come into force on 4th May 1988.
        2.    The area of the Metropolitan Borough of Gateshead is designated as an area to which section 10 (prohibition of unauthorised camping in designated areas) of the Caravan Sites Act 1968 applies.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order designates the Metropolitan Borough of Gateshead as an area to which section 10 of the Caravan Sites Act 1968 applies.
    It is an offence within a designated area for a gipsy to station a caravan for the purpose of residing for any period on any land within the boundaries of a highway, or on any other unoccupied land, or on any occupied land without the consent of the occupier.
    Under section 11 of the Act (substituted by section 174 of the Local Government, Planning and Land Act 1980), unlawfully stationed caravans and their occupants may be removed by order of a magistrates' court.
