EDUCATION, ENGLAND AND WALES

The Education (Training Grants) (Amendment) Regulations 1988

Made 29th February 1988
Laid before Parliament 10th March 1988
Coming into force 1st April 1988

    In exercise of the powers conferred on the Secretary of State by sections 50 and 63 of the Education (No.2) Act 1986[1], I hereby make the following Regulations:
        1.    These Regulations may be cited as the Education (Training Grants) (Amendment) Regulations 1988 and shall come into force on the 1st April 1988.
        2.    In these Regulations a reference to the principal Regulations is a reference to the Education (Training Grants) Regulations 1987[2].
        3.    In regulation 10 of the principal Regulations —
       (a) for paragraph (2) there shall be substituted the following paragraph—
        "  (2)  Claims for the payment of grant shall relate to such period and contain such particulars as the Secretary of State may determine." ;
       (b) paragraph (3) shall be deleted;
       (c) in paragraph (4) there shall be substituted for the words "quarter commencing on 1st April" the words "three months following that date";
       (d) in paragraph (5) there shall be substituted for the words "expenditure by an authority incurred in the quarter beginning on the 1st October in any year or any subsequent quarter" the words "a claim made by an authority on or after the 1st October of any year"; and
       (e) paragraph (7) shall be deleted.
        4.    In regulation 12 of the principal Regulations—
       (a) in paragraph (2) there shall be substituted for the words "have been fulfilled" the words "have either been fulfilled or been withdrawn in pursuance of paragraph (4).";
       (b) after paragraph (3) there shall be added the following paragraph—
        "  (4)  The Secretary of State may determine to withdraw or, after consulting the authority, vary conditions determined in pursuance of this regulation." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Education (Training Grants) Regulations 1987 ("the principal Regulations").
    First, regulation 10 of the principal Regulations is amended so that claims are no longer required to relate to expenditure over one or more quarters or to contain the information specified in paragraph (3) of that regulation but are instead to relate to expenditure over such period and contain such particulars as the Secretary of State may determine. Consequential amendments are made to other provisions in that regulation (regulation 3).
    Secondly, regulation 12 of the principal Regulations is amended to enable the Secretary of State to withdraw or, after consulting the authority, vary conditions determined under that regulation (regulation 4).
