PUBLIC PASSENGER VEHICLES

The Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) (Amendment) Regulations 1988

Coming into force 1st April 1988

    The Secretary of State for Transport, in exercise of the powers conferred by sections 52(1)(a) and 60(1) of the Public Passenger Vehicles Act 1981[1] , and of all other enabling powers, and after consultation with representative organisations in accordance with section 61(2) of that Act, hereby makes the following Regulations:—
        1.    These Regulations may be cited as the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) (Amendment) Regulations 1988 and shall come into force on 1st April 1988.
        2.    The Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations 1981[2] are hereby amended in accordance with the following provisions of these Regulations.
        3.    In the regulations specified in column 1 of the Table below for the words specified in column 2 of that Table there shall be substituted the words specified in column 3 of the Table.

        4.    At the end of regulation 57 there shall be added the following paragraph—
      "  (5)  the prescribed fee for the issue of a copy of a certificate under this regulation is £7.50" .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend the Public Service Vehicles (Conditions of Fitness, Equipment, Use and Certification) Regulations 1981 so that:—
      (a) the fee payable for a certificate of initial fitness is increased from £100 to £110, both on the first application, and on any subsequent application when the test includes a test of stability under regulation 6. The fee payable for the certificate on any other subsequent application is increased from £11.50 to £13;
      (b) the fees payable for type approvals are increased from £580, £55, £290 and £1240 to—respectively—£640, £60, £320 and £1320; and
      (c) the fee payable for a certificate of conformity is increased from £13 to £14.50.
      (d) a new fee of £7.50 is introduced for the issue of duplicate certificates.
