TRADE UNIONS

The Certification Officer (Amendment of Fees) Regulations 1988

Made 23rd February 1988

Coming into force 1st April 1988

    The Secretary of State, in exercise of the powers conferred on him by section 7 of the Trade Union (Amalgamations, etc.) Act 1964([1] ) and section 8(4) of the Trade Union and Labour Relations Act 1974([2] ) and section 8(2) of the Employment Protection Act 1975([3] ) and of all other powers enabling him in that behalf, and as respects regulation 2 with the approval of the Treasury, hereby makes the following Regulations:—
    Citation, commencement and revocation
        1.—(1)  These Regulations may be cited as the Certification Officer (Amendment of Fees) Regulations 1988 and shall come into force on 1st April 1988.

        (2)  The Certification Officer (Amendment of Fees) Regulations 1987([4] ) are hereby revoked.
    Amendment of fees payable to the Certification Officer
        2.—(1)  In paragraph (1) of regulation 3 of the Trade Unions and Employers' Associations (Amalgamations, etc.) Regulations 1975([5] ) (the "1975 Regulations" ), after the word "Regulations," there shall be inserted the words "by the fee prescribed by Regulation 11(1)" .

        (2)  For regulation 11 of the 1975 Regulations there shall be substituted the following regulation:—
            "11.—(1)  The fee referred to in Regulation 3(1) (fee to accompany an application for approval of a proposed instrument of amalgamation or transfer) shall be £175.

            (2)  The following fees shall be payable in advance—
        For approval of a change of name £14
        For every inspection on the same day of documents kept by the Certification Officer under the 1964 Act relating to one and the same organisation £3.
        " .


        3.    In section 8(4) of the Trade Union and Labour Relations Act 1974 for the words "£26" (fee on application by an organisation of workers or of employers to have its name entered in the list of trade unions or employers' associations, as the case may be) there shall be substituted the words "£40" .
        4.    In section 8(2) of the Employment Protection Act 1975 for the words "£156" (fee on application by a trade union for a certificate of independence) there shall be substituted the words "£194" .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations which come into force on the 1st April 1988, amend regulation 11 of the Trade Unions and Employers' Associations (Amalgamations, etc.) Regulations 1975 so that a fee becomes payable on application to the Certification Officer under the Trade Union (Amalgamations, etc.) Act 1964 for approval of an instrument of amalgamation or transfer instead of when application is made for the registration of such an instrument.
    The Regulations also increase the fees specified herein payable to the Certification Officer. The fees for approval of a change of name and the inspection of documents kept under the 1964 Act are increased respectively from £8 to £14 and from £2 to £3.
    The Regulations revoke the Certification Officer (Amendment of Fees) Regulations 1987, which previously prescribed these fees.
    Regulation 3 of the Certification Officer (Amendment of Fees) Regulations 1981 remains in force and prescribes the fee payable to the Certification Officer for the entry of an amalgamated organisation on the list of trade unions or employers' associations maintained by the Certification Officer under section 8 of the Trade Union and Labour Relations Act 1974 where each of the amalgamating organisations is already entered on the list (£12.50), which has not been increased.
