The Export of Sheep (Prohibition) (No.2) Amendment Order 1988

Made 5th January 1988
Coming into force 11th January 1988

    The Minister of Agriculture, Fisheries and Food, in exercise of the power conferred by section 11 of the Animal Health Act 1981[1] and of all other powers enabling him in that behalf, hereby makes the following Order:—
    Title and commencement
        1.    This Order may be cited as the Export of Sheep (Prohibition) (No.2) Amendment Order 1988 and shall come into force on 11th January 1988.
    Amendment of the Export of Sheep (Prohibition) (No.2) Order 1987
        2.    The Export of Sheep (Prohibition) (No.2) Order 1987[2] is hereby amended by substituting for article 2(4)(b) the following sub-paragraph:—
        "(b) any sheep which was marked with a blue mark, with an apricot mark or with a green mark as a condition of the granting of a consent under section 2(1) of that Act to its removal from a designated area given on or before 21st December 1986, 26th July 1987 or 27th September 1987 respectively." .

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order amends the Export of Sheep (Prohibition) (No.2) Order 1987 ("the principal Order" ) which prohibits, subject to exceptions, the export from Great Britain to a Member State of the European Communities of—
      (a) sheep moved from a place in an area designated for the purposes of Part I of The Food and Environment Protection Act 1985 in accordance with the terms of a consent under section 2(1) of that Act which required that the sheep to which it applies should be marked in a specified manner; and
      (b) sheep which have been moved in contravention of a restriction imposed by an order made under section 1 of that Act.

    The principal Order does not apply to those sheep which have been examined and subsequently marked with an ear-tag by an officer authorised by the Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland or Wales or the Department of Agriculture for Northern Ireland or to those sheep moved from a place in a designated area in accordance with the terms of a consent given on or before a specified date which required them to be marked with a blue or with an apricot paint mark. This Order extends the latter exception to any sheep moved from a place in a designated area in accordance with the terms of a consent given on or before 27th September 1987 which required it to be marked with a green paint mark.
