PENSIONS

The Personal Pension Schemes (Deferment of Commencement) Regulations 1987

Coming into force 15th December 1987

    The Secretary of State for Social Services, in exercise of the powers conferred upon him by sections 1(1), (2), (4), (5), (9), (10) and (11), 2(1), (2) and (5), 3(1)(b), (2) and (5), 12(1) and 84(1) of the Social Security Act 1986[1] , and of all other powers enabling him in that behalf, by this instrument, which is made before the end of a period of 12 months from the commencement of the enactments under which it is made, makes the following Regulations:—
    Citation and commencement
        1.    These Regulations may be cited as the Personal Pension Schemes (Deferment of Commencement) Regulations 1987 and shall come into force on 15th December 1987.
    Revocation
        2.    The Personal Pension Schemes (Appropriate Schemes) Regulations 1987[2] are hereby revoked.
    Amendment of the Pension Schemes (Voluntary Contributions Requirements and Voluntary and Compulsory Membership) Regulations 1987
        3.    Regulation 2(2) of the Pension Schemes (Voluntary Contributions Requirements and Voluntary and Compulsory Membership) Regulations 1987[3] shall be amended by substituting for the date "4th January 1988" the date "1st July 1988" .
    Amendment of the Personal and Occupational Pension Schemes (Incentive Payments) Regulations 1987
        4.    Sub-paragraphs (2)(b) and (3)(b) of regulation 2 of the Personal and Occupational Pension Schemes (Incentive Payments) Regulations 1987[4] shall be amended in each case by substituting for the date "3rd January 1988" the date "5th April 1988" .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations are made under the Social Security Act 1986 ("the 1986 Act" ) before the expiry of the period of 12 months beginning with the bringing into force of the sections under which they are made.
    Consequently, by virtue of section 61(5) of the 1986 Act, the provisions of section 61(2) and (3) of the Social Security Pensions Act 1975 (c. 60) (which, as amended by section 86(1) of, and paragraph 94 of Schedule 10 to, the 1986 Act, require reference to the Occupational Pensions Board of, and a report by the Board on, proposals to make regulations for the purpose of Part I of the 1986 Act), do not apply to them.
    The Regulations revoke the Personal Pension Schemes (Appropriate Schemes) Regulations 1987 and make consequential amendments to the Pension Schemes (Voluntary Contributions Requirements and Voluntary and Compulsory Membership) Regulations 1987 and the Personal and Occupational Pension Schemes (Incentive Payments) Regulations 1987.
