LAND DRAINAGE

The Severn-Trent Water Authority (Reconstitution of the Rivers Idle and Ryton Internal Drainage Board) Order 1987

Made 28th July 1987
Coming into force 3rd November 1987

    Whereas the Severn-Trent Water Authority (hereinafter called "the Water Authority" ) are the drainage board, as constituted by the Trent River Board (Rivers Idle and Ryton Internal Drainage District) Order 1963[1] of the Rivers Idle and Ryton Internal Drainage District (hereinafter called "the Internal Drainage District" );
    And whereas the Water Authority have received and have submitted a petition to the Minister of Agriculture, Fisheries and Food (hereinafter called "the Minister" ) for an Order under section 13 of the Land Drainage Act 1976[2] (hereinafter called "the 1976 Act" ) in relation to the Rivers Idle and Ryton Internal Drainage Board (hereinafter called "the Internal Drainage Board" );
    Now, therefore the Minister, in exercise of the powers conferred upon him by sections 13 and 109(6) of the 1976 Act, and of all other powers enabling him in that behalf, hereby makes the following Order:
        1.    This Order may be cited as the Severn-Trent Water Authority (Reconstitution of the Rivers Idle and Ryton Internal Drainage Board) Order 1987 and shall, unless subject to special parliamentary procedure, come into operation on the date of its confirmation by the Minister.
        2.    On a day to be appointed by the Minister (hereinafter called "the appointed day" ) the following provisions shall have effect:
       (i) the Internal Drainage Board for the Internal Drainage District shall be reconstituted and shall consist of nine members who, with the exception of the first members, shall be elected in accordance with the provisions of section 7 of, and Schedule 2 to, the 1976 Act. The said first members of the Internal Drainage Board shall be persons appointed by the Minister and shall hold office until the expiration of one year from the first day of November next following the day on which they are appointed;
       (ii) the property, rights, powers, duties, obligations and liabilities which were immediately before the appointed day vested in or to be discharged by the Water Authority shall be transferred to and vested in or be discharged by the Internal Drainage Board as reconstituted by this Order.
        3.    The expenses of the Minister in connection with the making and confirmation of this Order shall be borne by the Water Authority and shall be part of the administrative expenses of that Authority.

Whereas the foregoing Order has been published by the Minister of Agriculture, Fisheries and Food in accordance with the procedure prescribed by the Land Drainage Act 1976;
And whereas no memorial against the Order has been presented to the Minister;
Now, therefore, the Minister, in pursuance of the powers in the said Order recited, hereby confirms the said Order.

Whereas the Severn-Trent Water Authority (Reconstitution of the Rivers Idle and Ryton Internal Drainage Board) Order 1987 provides that the appointed day therein mentioned shall be a day to be appointed by the Minister of Agriculture, Fisheries and Food;
Now, therefore, the Minister of Agriculture, Fisheries and Food hereby appoints the 5th November 1987 to be the said appointed day.

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order, made by the Minister of Agriculture, Fisheries and Food on the petition presented to him by the Severn-Trent Water Authority, provides for the reconstitution of the Rivers Idle and Ryton Internal Drainage Board, which Board was constituted by the Scheme confirmed by the Trent River Board (Rivers Idle and Ryton Internal Drainage District) Order 1963, and for vesting in the reconstituted board the property and liabilities of the Severn-Trent Water Authority so far as vested in or incurred by them in their capacity as the drainage board for that district.
