The Insolvency (Scotland) Amendment Rules 1987

Made 9th November 1987
Laid before Parliament 24th November 1987
Coming into force 11th January 1988

    The Secretary of State, in exercise of the powers conferred on him by section 411 of the Insolvency Act 1986[1], and of all other powers enabling him in that behalf, hereby makes the following Rules:
    Citation and commencement
        1.    These Rules may be cited as the Insolvency (Scotland) Amendment Rules 1987 and shall come into force on 11th January 1988.
    Interpretation
        2.    In these Rules, "the principal Rules" means the Insolvency (Scotland) Rules 1986[2] and, unless the context otherwise requires, any reference to a Rule or Schedule or form is a reference to that Rule or Schedule or form in the principal Rules.
    Amendment and application
        3.—(1)  Subject to paragraphs (2) and (3) the principal Rules shall be amended in accordance with the provisions of the Schedule to these Rules.

        (2)  The principal Rules as so amended shall apply on and after the date on which these Rules come into force to all insolvency proceedings to which the principal Rules apply, whenever such proceedings have commenced.

        (3)  Any form which is substituted by a form ("a new form") contained in Part III of the Schedule to these Rules may continue to be used instead of the new form for the purpose for which it was prescribed, and with such variations as circumstances require, until 1st March 1988.
