TOWN AND COUNTRY PLANNING, SCOTLAND

The Housing and Planning Act 1986 (Commencement No. 7) (Scotland) Order 1987

The Secretary of State, in exercise of the powers conferred on him by section 57(2) of the Housing and Planning Act 1986^[1], and of all other powers enabling him in that behalf, hereby makes the following Order:

    1.    This Order may be cited as the Housing and Planning Act 1986 (Commencement No. 7) (Scotland) Order 1987.

    2.    The following provisions of the Housing and Planning Act 1986 shall come into force on 1st October 1987:—
 (a) section 26 (simplified planning zones in Scotland) and Parts III and IV of Schedule 6;
 (b) section 50 (listed buildings and conservation areas) and Part II of Schedule 9; and
 (c) section 51 (grants for repair of buildings in town schemes).

This Order brings into force on 1st October 1987 sections 26, 50 and 51 of, and Parts III and IV of Schedule 6 and Part II of Schedule 9 to, the Housing and Planning Act 1986.

Section 26 inserts into the Town and Country Planning (Scotland) Act 1972 new sections 21A - 21E and a new Schedule 6A which impose upon district and general planning authorities a duty to consider whether it would be desirable to establish simplified planning zones in their area and, where they decide that it would be beneficial to do so, to make schemes establishing such zones. They also prescribe some of the procedures to be followed in the making or alteration of a simplified planning zone scheme. Certain other provisions of the Town and Country Planning (Scotland) Act 1972 are amended to take account of the introduction of simplified planning zones.

Section 50 amends enactments relating to listed buildings and conservation areas with respect to the matters listed in that section and provided for in detail in Part II of Schedule 9.

Section 51 sets out the procedure under which the Secretary of State may give grants towards the cost of repairing buildings comprised in town schemes (ie. repair schemes in certain conservation areas jointly funded by the Secretary of State and the local authority).
