LOCAL GOVERNMENT, ENGLAND AND WALES
CHANGES IN LOCAL GOVERNMENT AREAS

The Essex (District Boundaries) Order 1987

Made 5th September 1987
Laid before Parliament 21st September 1987
Coming into force—
  for the purpose of article 1(2) 1st January 1988
  for all other purposes 1st April 1988


    The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972[1] and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47 and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
    Citation and commencement
        1.—(1)  This Order may be cited as the Essex (District Boundaries) Order 1987.

        (2)  This Order shall come into force on 1st January 1988 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976[2].

        (3)  For all other purposes this Order shall come into force on 1st April 1988.
    Transfer from the district of Braintree to the district of Maldon
        2.    The area of the district of Braintree and the parish of Witham which is marked Area A on the map prepared by the Department of the Environment, marked "Map of the Essex (District Boundaries) Order 1987" and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976 shall be transferred to—

      (a)  the district of Maldon;

      (b)  the Wickham Bishops ward of that district;

      (c)  the parish of Wickham Bishops;

      (d)  the Tollesbury electoral division of the county of Essex;

      (e)  the Dengie and Maldon petty sessional division.
    Town and Country Planning
        3.    Any provisions of a local plan adopted by the Braintree District Council which apply immediately before 1st April 1988 to the area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan adopted by the Maldon District Council.
    Land Registration
        4.    Registration of title to land under the Land Registration Acts 1925 to 1986[3] shall cease to be compulsory on sale in the area transferred by this Order save insofar as section 154(1) of the Housing Act 1985[4] applies to any dwelling-house situated in that area.

EXPLANATORY NOTE

(This note is not part of the Order)

    This Order transfers an area of the district of Braintree and parish of Witham to the district of Maldon and parish of Wickham Bishops. Consequential changes to local government electoral areas are made.
    The map forming part of this note (page 3) gives a general guide to the areas affected. Prints of the detailed boundary map (described in article 2) may be inspected at all reasonable times at the offices of the Braintree and Maldon district councils, and at the office of the Secretary of State for the Environment, 2 Marsham Street, London SW1P3EB
    The area transferred has approximately an area of 109 hectares, a population of 80 and a rateable value of £11,940.
    The Local Government Area Changes Regulations (S.I. 1976/246, amended by S.I. 1978/247) contain general provisions regarding the effect of orders such as this one.
