LOCAL GOVERNMENT, ENGLAND AND WALES
CHANGES IN LOCAL GOVERNMENT AREAS

The Devon (District Boundaries) Order 1987

Made 7th September 1987
Laid before Parliament 10th September 1987
Coming into force
  for the purpose of article 1(2) 1st October 1987
  for all other purposes 1st April 1988


    The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972[1] and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect with modifications to proposals submitted to him under sections 47 and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:
    Citation and commencement
        1.—(1)  This Order may be cited as the Devon (District Boundaries) Order 1987.

        (2)  This Order shall come into force on 1st October 1987 for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976[2].

        (3)  For all other purposes this Order shall come into force on 1st April 1988.
    Interpretation
        2.    In this Order—
      "boundary map" means one of the 4 maps prepared by the Department of the Environment, marked "Maps of the Devon (District Boundaries) Order 1987", duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976;

      "city ward" means a ward of the City of Exeter;

      "county electoral division" means an electoral division of the county of Devon;

      "district ward" means a ward of the relevant district council.

    Transfers between districts
        3.—(1)  The area or areas marked on a boundary map as shown in columns 1 and 2 of the Schedule to this Order shall cease to be part of the relevant local government area named in column 3 and shall become part of that named in column 4.

        (2)  Where in column 5 there is mentioned in relation to any area—

      (a)  a city or district ward;

      (b)  a county electoral division; and

      (c)  a petty sessional division
    that area shall in addition be transferred to that ward or division.
    Town and Country Planning
        4.    Any provisions of a local plan adopted by a district council which apply immediately before 1st April 1988 to an area transferred by this Order shall continue to have effect in relation to that area as if they were part of such a plan adopted by the council of the district to which that area is transferred.
    Statutory definitions of areas
        5.    For the purposes of regulation 40 (Statutory definitions of areas) of the Local Government Area Changes Regulations 1976, any reference to the area of the former county borough of Exeter shall be construed as including the areas transferred to the City of Exeter by article 3 and the Schedule, and excluding the areas transferred from the City of Exeter by that article and Schedule.
