COAL INDUSTRY

The Redundant Mineworkers and Concessionary Coal (Payments Schemes) (Amendment) Order 1987

Made 20th July 1987
Coming into force 27th July 1987

    The Secretary of State, in exercise of the powers conferred on him by section 7(1) and (7) of the Coal Industry Act 1977[1] , hereby makes the following Order, a draft of which has been laid before the Commons House of Parliament and has been approved by that House in accordance with section 7(7) of that Act:
    Citation and commencement
        1.    This Order may be cited as the Redundant Mineworkers and Concessionary Coal (Payments Schemes) (Amendment) Order 1987 and shall come into force on 27th July 1987.
    Amendments of 1973 Order
        2.    The Redundant Mineworkers and Concessionary Coal (Payments Schemes) Order 1973[2] shall be further varied in the Schedule as follows —
       (a) in Article 1, after the definition of "prescribed place" shall be inserted the following definition:
          ""reduced earnings allowance" means reduced earnings allowance under section 59A of the Social Security Act 1975;"

       (b) in Article 6, sub-paragraph (i)(a) of paragraph (1), shall be inserted after the words "special hardship allowance in respect of" the words ", or reduced earnings allowance payable in consequence of," .
    Amendments of 1978 Order
        3.    The Redundant Mineworkers and Concessionary Coal (Payments Schemes) Order 1978[4] shall be further varied in the Schedule as follows —
       (a) in Article 1 —
         (i) after the definition of "house" shall be inserted the following definition:
            ""income support" means income support under a scheme made under section 20(1) of the Social Security Act 1986;"
        [5]
         (ii) after the definition of "prescribed place" shall be inserted the following definition:
            ""reduced earnings allowance" means reduced earnings allowance under section 59A of the Social Security Act 1975," ;
       (b) in Article 5, paragraph (8), at the end shall be inserted the words "or under a scheme made under section 20(1) of the Social Security Act 1986" ;
       (c) in Article 6 —
         (i) in sub-paragraph (a)(i) of paragraph (1) after the words "special hardship allowance in respect of" shall be inserted the words ", or reduced earnings allowance payable in consequence of," ;
         (ii) after sub-paragraph (c)(x) of paragraph (1) for the words "or supplementary pension" in both places where they occur shall be inserted the words ", supplementary pension or income support" .
    Amendments of 1983, 1984 and 1986 Orders
        4.    The Redundant Mineworkers and Concessionary Coal (Payments Schemes) Order 1983[6] , the Redundant Mineworkers and Concessionary Coal (Payments Schemes) Order 1984[7] and the Redundant Mineworkers and Concessionary Coal (Payments Schemes) Order 1986[8] shall be varied, or further varied, in the Schedule to each such Order as follows —
       (a) in Article 1 —
         (i) after the definition of "house" shall be inserted the following definition:
            ""income support" means income support under a scheme made under section 20(1) of the Social Security Act 1986;"
         (ii) after the definition of "prescribed place" shall be inserted the following definition:
            ""reduced earnings allowance" means reduced earnings allowance under section 59A of the Social Security Act 1975;" ;
       (b) in Article 5, paragraph (6), at the end shall be inserted the words "or under a scheme made under section 20(1) of the Social Security Act 1986" ;
       (c) in Article 7 —
         (i) in paragraph (a)(i) after the words "special hardship allowance in respect of" shall be inserted the words ", or reduced earnings allowance payable in consequence of," ;
         (ii) in paragraph (c)(vi) for the words "or supplementary pension" in both places where they occur shall be substituted the words ", supplementary pension or income support" .

EXPLANATORY NOTE

(This note is not part of the Order)
    This Order makes consequential amendments to the Redundant Mineworkers Payments Schemes scheduled to the Redundant Mineworkers and Concessionary Coal (Payments Schemes) Orders 1973, 1978, 1983, 1984 and 1986 arising from changes to social security legislation made by the Social Security Act 1986.
    The Order inserts into the provisions of the Schemes which regulate the amount of basic weekly benefit payable references to the new statutory basis for rent rebate and rent allowance and references to reduced earnings allowance and income support (which replace special hardship allowance and supplementary benefit).
