ROAD TRAFFIC

The International Carriage of Perishable Foodstuffs (Vehicles With Thin Side Walls) Regulations 1987

    The Secretary of State for Transport in exercise of the powers conferred by section 56(1) and (2) of the Finance Act 1973[1] , and of all other enabling powers, with the consent of the Treasury, hereby makes the following Regulations:—
    Commencement and citation
        1.    These Regulations shall come into force on 4th June 1987 and may be cited as the International Carriage of Perishable Foodstuffs (Vehicles With Thin Side Walls) Regulations 1987.
    Fees
        2.—(1)  The fees payable in connection with the testing of units of transport equipment for conformity with the constructional requirements specified in Articles 2 and 4 of the Agreement of the 24th June 1986 shall be—
       (a) where the testing is carried out at the Refrigerated Vehicle Test Centre, a fee of £55 per unit;
       (b) where the testing is carried out at a place other than the Refrigerated Vehicle Test Centre—
         (i) a fee of £160 for each unit for up to four units presented at the same time, and
         (ii) a fee of £40 for each unit in addition.

        (2)  The Agreement of the 24th June 1986 referred to in the preceding paragraph is the Agreement on the rules governing the carriage of frozen and deep frozen foodstuffs by equipment with thin side walls to and from Italy made at Paris on the 24th Ju ne 1986 between the Governments of the Italian Republic, the French Republic, the Federal Republic of Germany, the Kingdom of Belgium, the Kingdom of Denmark, the United Kingdom and the Kingdom of the Netherlands.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations prescribe the fees payable in connection with the testing of units of transport equipment with thin side walls used for the international carriage of frozen and deep frozen foodstuffs to and from Italy between 1st April and 31st October, for conformity with the constructional requirements of the Agreement of 24th June 1986 specified in Regulation 2(2). This agreement was entered into in conformity with Article 7 of the Agreement on the International Carriage of Perishable Foodstuffs and on the Special Equipment to be used for such Carriage (ATP) of the 1st September 1970 (Cmmd 8272). Copies of the Agreement of 24th June 1986 may be obtained from the Department of Transport, Room S10/13, 2 Marsham Street, London, SW1P 3EB.
    The fees prescribed are—
      (a) where the testing is carried out at the Refrigerated Vehicle Test Centre, a fee of £55 per unit;
      (b) where the testing is carried out at a place other than the Refrigerated Vehicle Test Centre—
        (i) a fee of £160 for each unit for up to four units presented at the same time, and
        (ii) a fee of £40 for each unit in addition.
