The Patents (Fees) (Amendment) Rules 1987

Coming into force 27th April 1987

    The Secretary of State, in exercise of the powers conferred on him by section 123(1), (2) and (3) of and paragraph 14 of Schedule 4 to the Patents Act 1977[1] (a), after consultation with the Council on Tribunals pursuant to section 10(1) of the Tribunals and Inquiries Act 1971[2] (b) and with the consent of the Treasury pursuant to subsection (4) of the said section 123, hereby makes the following Rules:
        1.    These Rules may be cited as the Patents (Fees) (Amendment) Rules 1987 and shall come into force on 27th April 1987.
        2.    The Patents (Fees) Rules 1987[3] (c) shall have effect subject to the following amendments:
       (a) for Rule 4 thereof there shall be substituted the following Rule:
              "4.    Where application is made, or by virtue of section 120(2) of the Patents Act 1977 is taken to have been made, on or after 27th April 1987 but before 26th May 1987 for renewal of a patent in respect of any year beginning on or after 26th May 1987, the fee payable on such application shall be that which would be payable if the application were made on or after 26th May 1987 and Rules 1(2) and 3 above had come into force." ; and
       (b) in the item corresponding to Patents Form No. 53/77 in Part A of the Schedule to the said Rules, for the reference to Rule 100(3C) there shall be substituted a reference to Rule 110(3C).

EXPLANATORY NOTE

(This note is not part of the Rules)
    The Patents (Fees) Rules 1987 contain two errors:
      (i) Rule 4 contains two references to 26th May 1986 which should be to 26th May 1987;
      (ii) the item corresponding to Patents Form No. 53/77 in Part A of the Schedule refers to Rule 100(3C) instead of Rule 110(3C).

    These Rules correct those errors.
