LOCAL GOVERNMENT, ENGLAND AND WALES
CHANGES IN LOCAL GOVERNMENT AREAS

The Hereford and Worcester (District Boundaries) Order 1987

Made 3rd March 1987
Laid before Parliament 9th March 1987
Coming into force—
  for the purposes described in article 2(1) 30th March 1987
  for all other purposes 1st April 1987


    Whereas the Local Government Boundary Commission for England, acting pursuant to sections 47 and 51(1) of the Local Government Act 1972[1]has made proposals to the Secretary of State for alterations in the boundaries between the city of Worcester and the districts of Wychavon and Malvern Hills:
    And whereas more than six weeks has elapsed since those proposals were made:
    And whereas the Secretary of State has decided to give effect to the proposals:
    Now, therefore, the Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of that Act and of all other powers enabling him in that behalf, hereby makes the following order:—
    Title and commencement
        1.    This order may be cited as the Hereford and Worcester (District Boundaries) Order 1987.
        2.—(1)  30th March 1987 is hereby specified as the day on which this order shall come into force for any purpose set out in regulation 4(1) (coming into operation of order) of the Local Government Area Changes Regulations 1976[2].

        (2)  For all other purposes, this order shall come into force on 1st April 1987.
    Interpretation
        3.    In this order—
      "boundary maps" means the 2 maps prepared by the Department of the Environment, marked "Maps of the Hereford and Worcester (District Boundaries) Order 1987", duly numbered for reference, and deposited in accordance with regulation 5 of the Local Government Area Changes Regulations 1976; and

      "county electoral division" means an electoral division of the county of Hereford and Worcester.

    Transfers between districts
        4.—(1)  Each area marked on the boundary maps as shown in columns 1 and 2 of the Schedule hereto shall cease to be part of the relevant local government areas named in column 3 and shall become part of the relevant local government areas named in column 4.

        (2)  Where in column 5 there is mentioned in relation to any area—

      (a)  a parish ward;

      (b)  a district or city ward;

      (c)  a county electoral division; or

      (d)  a petty sessional division—
    that area shall additionally be transferred to that ward or division.
    Electoral Arrangements in the District of Wychavon
        5.    From the fourth day after the ordinary day of election of councillors in 1987 the Claines Central and West ward and the Claines East ward of the district of Wychavon shall be amalgamated to form a new ward of that district to be called the North Claines ward. It shall be represented by 2 district councillors.
    Town and Country Planning
        6.    Any provisions of a local plan adopted by a city or district council which apply immediately before 1st April 1987 to an area transferred by this order shall continue to have effect in relation to that area as if they were part of such a plan adopted by the council of the city or district to which the area is transferred.
    Land Registration
        7.    Registration of title to land under the Land Registration Acts 1925 to 1986[3] shall

      (i)  be compulsory on sale throughout the city of Worcester as altered by article 4; and

      (ii)  cease to be compulsory on sale in any area transferred from the city of Worcester to the districts of Malvern Hills and Wychavon save in so far as section 154(1) of the Housing Act 1985[4] applies to any dwelling house situated in that area.
