SOCIAL SECURITY

The Social Security (Unemployment, Sickness and Invalidity Benefit) Amendment Regulations 1987

Coming into force 4th March 1987

    The Secretary of State for Social Services in exercise of the powers conferred on him by sections 17(2)(a) and 166 of, and Schedule 20[1] to, the Social Security Act 1975[2] and of all other powers enabling him in that behalf, without having referred any proposals to make these regulations to the Social Security Advisory Committee because it appears to him that by reason of the urgency of the matter it is inexpedient to do so[3] , hereby makes the following Regulations:—
    Citation and commencement
        1.    These Regulations may be cited as the Social Security (Unemployment, Sickness and Invalidity Benefit) Amendment Regulations 1987 and shall come into force on 4th March 1987.
    Amendment of the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations 1983
        2.    After sub-paragraph (m) of paragraph (1) of regulation 7 of the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations 1983[4] there shall be inserted the following sub-paragraph—
        "(n) a day shall not be treated as a day of unemployment in relation to any person if it falls in a week during any part of which that person is employed in employment under arrangements made by the Secretary of State under section 5 of the Employment and Training Act 1973[5] ; but this sub-paragraph does not apply to any day before the first day of employment in the first week in which he is employed under such arrangements or after the last day of employment in the last week in which he is so employed." .

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations amend regulation 7(1) of the Social Security (Unemployment, Sickness and Invalidity Benefit) Regulations 1983 so as to provide that a day shall not be treated as a day of unemployment if it falls in a week for any part of which the claimant is employed under arrangements made by the Secretary of State under section 5 of the Employment and Training Act 1973.
