The Supplementary Benefit (Single Payments) Amendment Regulations 1987

    The Secretary of State for Social Services, in exercise of the powers conferred upon him by sections 3, 14(2)(a) and 34(1)[1] of the Supplementary Benefits Act 1976[2] , section 166(2) and (3) of the Social Security Act 1975[3] and of all other powers enabling him in that behalf, without having referred any proposals on the matter to the Social Security Advisory Committee since it appears to him that by reason of urgency it is inexpedient to do so[4] , hereby makes the following Regulations:—
    Citation, commencement and interpretation
        1.—(1)  These Regulations which may be cited as the Supplementary Benefit (Single Payments) Amendment Regulations 1987 shall come into force as follows:-
       (a) regulations 1 and 3 on 21st January 1987;
       (b) regulation 2 on 26th January 1987.

        (2)  In these Regulations—
      "the Single Payments Regulations" means the Supplementary Benefit (Single Payments) Regulations 1981[5]

    Amendment of regulation 26A of the Single Payments Regulations
        2.    In regulation 26A(5)(a) (definition of a period of exceptionally cold weather) for the words "minus 1.5 degrees Celsius" there shall be substituted "0 degrees Celsius" .
    Supplementary provision for cases before amendment of regulation 26A comes into force
        3.    In any case where a claim under regulation 26A of the Single Payments Regulations (exceptionally cold weather) is made or treated as made in respect of the period of 7 days ending immediately before regulation 2 of these Regulations comes into force, the average mean daily temperature recorded for that period at the designated station shall be treated as equal to minus 1.5 degrees Celsius.

EXPLANATORY NOTE

(This note is not part of the Regulations)
    These Regulations further amend the Supplementary Benefit (Single Payments) Regulations 1981 relating to single payments for exceptionally cold weather. They substitute for the average temperature of minus 1.5 degrees Celsius a temperature of 0 degrees Celsius; and for the purposes of a claim made under regulation 26A in respect of a period of 7 days ending on 25th January 1987, they provide for the average temperature to be treated as equal to minus 1.5 degrees Celsius.
    These Regulations will be referred to the Social Security Advisory Committee under section 61(2) of the Social Security Act 1986.
