The National Assembly for Wales, in exercise of the powers conferred upon it by section 233(1) and (4) of the Housing Act 2004[1] and having taken reasonable steps to consult the persons mentioned in section 233(2) (a) and (b), and being satisfied with the publication arrangements in accordance with section 233(3), hereby makes the following Order: Title, commencement and application 1. —(1) The title of this Order is The Housing (Approval of Codes of Management Practice) (Student Accommodation) (Wales) Order 2006 and it comes into force on 7 July 2006. (2) This Order applies in relation to premises in Wales. Approval of codes of practice 2. —(1) The codes of practice mentioned in paragraph (2) which lay down standards of conduct and practice to be followed with regard to the management of—
(b) buildings falling within paragraph 4 of Schedule 14 to the Housing Act 2004 (buildings occupied by students),
are approved for the purposes of section 233 of that Act.
(b) the Accreditation Network UK/Unipol Code of Standards for Larger Developments for Student Accommodation Managed and Controlled by Educational Establishments (Wales) dated 16 May 2006[4]; and (c) the Accreditation Network UK/Unipol Code of Standards for Larger Developments for Student Accommodation Not Managed and Controlled by Educational Establishments (Wales) dated 16 May 2006[5].
(This note is not part of the Order) This Order approves three codes of practice laying down standards of conduct and practice to be followed with regard to the management of houses in multiple occupation ("HMOs") and other buildings that are occupied solely or principally by full-time students. The other buildings mentioned are those falling within paragraph 4 of Schedule 14 to the Housing Act 2004 (which provides for a description of building occupied by students which is not a HMO for the purposes of that Act). In the case of these buildings, students who occupy them must do so for the purpose of undertaking full-time education courses at specified educational establishments. The Houses in Multiple Occupation (Specified Educational Establishments) (Wales) Regulations 2006 has been made to specify educational establishments for the purpose of paragraph 4 of Schedule 14.
