The National Assembly for Wales, in exercise of the powers conferred upon it by sections 47(5), 52(3), (4) and (6) of the Higher Education Act 2004[1] with the agreement of the Secretary of State[2] hereby makes the following Order: Title, application and interpretation 1. The title of this Order is the Higher Education Act 2004 (Commencement No.2 and Transitional Provision) (Wales) (Amendment) Order 2006. Amendment of Order 2. The Higher Education Act 2004 (Commencement No.2 and Transitional Provision) (Wales) Order 2005[3]is amended as follows: For article 5 substitute the following articles—
5A. Section 44(3) comes into force on 1 September 2006.".
(This note is not part of the Order) This Order amends the Higher Education Act 2004 (Commencement No.2 and Transitional Provision) Order 2005 ("the No.2 Order") by substituting a new coming into force date for section 44(4) of the Education Act 2004 (which transfers to the National Assembly the power of the Secretary of State under section 23 of the Teaching and Higher Education Act 1998 to transfer or delegate student support functions under regulations made under section 22 of that Act). That subsection, which under the No.2 Order was to have come into force on 1 September 2006, will now come into force on 23 June 2006.
