In exercise of the powers conferred on the National Assembly for Wales by sections 112 and 210(7) of the Education Act 2002[1], the National Assembly for Wales hereby makes the following Regulations: Title, commencement and application 1. —(1) The title of these Regulations is the Education (National Curriculum for Wales) (Disapplication of Science at Key Stage 4) Regulations 2005 and they come into force on 1 August 2006. (2) They apply only to maintained schools in Wales. Interpretation 2. —(1) In these Regulations–
(2) For the purposes of these Regulations, references to the requirements of the National Curriculum for Wales for science at the fourth key stage are references to the requirements of section 106(1) of the 2002 Act in so far as they apply to science[4].
(b) the qualification is a qualification in science in the NQF at Entry level, level 1 or level 2.
Expiry of Regulations (This note is not part of the Regulations) These Regulations apply to pupils in key stage 4 (broadly 14 – 16 year olds) attending community, foundation and voluntary schools and community and foundation special schools (other than schools maintained in hospitals) in Wales. The Regulations disapply the requirements of the National Curriculum for Wales for science in relation to a pupil if the head teacher of the school is satisfied that the pupil is pursuing a course leading to an approved external qualification from the National Qualifications Framework at entry level, level 1 or level 2. The requirements disapplied are those specified in section 106 of the Education Act 2002, which provides that the National Curriculum for key stage 4 is to comprise science (amongst other subjects) and is to specify attainment targets, programmes of study and assessment arrangements for that subject. The attainment targets and programmes of study for science are currently contained in a Document entitled ‘Science in the National Curriculum' (ISBN 07504 24028), copies of which are available from the Stationery Office Limited. There are no assessment arrangements. The disapplication applies for a limited period of 2 years (expiring at the end of July 2008).
