The National Assembly for Wales, in exercise of the powers conferred upon it by section 67(6) of the Children Act 2004[1], with the consent of the Secretary of State, hereby makes the following Order - Name and interpretation 1. - (1) This Order is called the Children Act 2004 (Commencement No.2) Order 2005. (2) In this Order "the Act" means the Children Act 2004. Appointed Day 2. - (1) 16 March 2005 is the appointed day for the coming into force of sections 42 and 43 of the Act; (2) 1 April 2005 is the appointed day for the coming into force of sections 35, 36, 37, 38, 39, 40 and 41 of the Act. Elis-Thomas The Presiding Officer of the National Assembly 15 March 2005 (This note is not part of the Order) This Order is the second Commencement order made under the Children Act 2004 ("the Act"). The Order brings sections 35 to 43 of and Schedule 3 to the Act, which relate to CAFCASS functions in Wales, into force in England and Wales. Sections 42 and 43 which deal with the transfers of property and staff are brought into force on 16 March 2005 and sections 35 to 41 and Schedule 3 are brought into force on 1 April 2005. (This note is not part of the Order) The provisions of the Children Act 2004 in respect of which an entry is made in the Table below have been brought into force in relation to England on the date specified alongside their entry by S.I. 2005/394 C.18, save where an entry is shown as being brought into force in relation to England and Wales.
