The National Assembly for Wales makes the following Regulations, in exercise of the powers conferred upon it by sections 9(2), 9(3) and 9(5) of the Adoption Act 1976[1] and of all other powers enabling it in that behalf. Citation, commencement, interpretation and application 1. - (1) These regulations may be cited as the Adoption of Children from Overseas (Wales) (Amendment) Regulations 2003. (2) These regulations come into force on 25th June 2003. (3) "the Principal Regulations" ("y prif Reoliadau") means The Adoption of Children from Overseas (Wales) Regulations 2001[2]. (4) These regulations apply to Wales. Amendment of the Principal Regulations 2. - (1) In regulation 2 of the Principal Regulations (Interpretation) remove the reference to and the definition of "the 2001 Regulations". (2) In regulation 3(1)(a) of the Principal Regulations (Duties of an adoption agency and adoption panel functions in respect of a prospective adopter), remove the words "regulation 3(2)(a) of the 2001 Regulations" and substitute the words "regulations made under section 56A of the Adoption Act 1976[3]". Elis-Thomas The Presiding Officer of the National Assembly for Wales 24th June 2003 (This note is not part of the Regulations) These regulations make a minor amendment to The Adoption of Children from Overseas (Wales) Regulations 2001 ("the Welsh Regulations") to take account of prospective changes to section 56A of the Adoption Act 1976 when the relevant parts of the Adoption and Children Act 2002 come into force. The effect of those changes is to render ineffective the Adoption of Children from Overseas Regulations 2001 which the Welsh Regulations 2001 refer to. These regulations remove that reference and instead refer to regulations made under section 56A of the Adoption Act 1976. Notes: [1] 1976 c.36 ("1976 Act"). The Adoption Service functions set out in section 1 of the 1976 Act, in relation to which the powers under section 9(2) and (3) are exercised, are amended by section 9 of the Adoption (Intercountry Aspects) Act 1999 (c.18)("the 1999 Act").back [2] S.I. 2001/1272 (W.71).back [3] 1976 c. 36. Section 56A was inserted by section 14 of the Adoption (Intercountry Aspects) Act 1999 (c.18). The 2001 regulations, which were made under section 56A, will be ineffective from the day of coming into force of a new section 56A to be introduced by the Adoption and Children Act 2002 (c. 38).back
