The Animal Gatherings (Interim Measures) (Wales) (Amendment) (No. 2) Order 2002

  Coming into force 1st August 2002 

The National Assembly for Wales and the Secretary of State, acting jointly in exercise of the powers conferred on them by sections 1,7 and 8 of the Animal Health Act 1981[1], make the following Order:

Title, application and commencement
     1. This Order may be cited as the Animal Gatherings (Interim Measures) (Wales) (Amendment) (No. 2) Order 2002; it applies to Wales only and shall come into force on 1st August 2002.

Amendment to the Animal Gatherings (Interim Measures) (Wales) Order 2002
    
2.  - (1) The Animal Gatherings (Interim Measures) (Wales) Order 2002[2] shall be amended in accordance with the following provisions of this article.

    (2) In article 2 - 

    (a) after the definition of "animal gathering", the following definition shall be inserted - 

      " "animals" ("anifeiliaid") means cattle (excluding bison and yak), deer, goats, sheep and swine;".

    (b) after the definition of "approved disinfectant", the following definition shall be added - 

      " "equipment" ("cyfarpar") shall include pens and hurdles.".

    (3) In the Schedule - 

    (a) in paragraphs 1 and 2, in each place where the words "28 days" occur, there shall be substituted the words "27 days";

    (b) in paragraph 1(b), the words "pens, hurdles and any other" shall be deleted; and

    (c) in paragraph 4, the words "pens, hurdles and any other" shall be deleted;.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order further amends the Animal Gatherings (Interim Measures) (Wales) Order 2002 (S.I. 2002/283 (W.34) ("the principal Order"), as amended by SI 2002/1358 (W.134).

This Order - 

    (a) Restricts the categories of animals to which the principal Order applies so as to include only cattle (excluding bison and yak), deer, goats, sheep and swine.

    (b) Defines the terms "equipment" for the purposes of the principal Order and amends the references to "pens, hurdles and other equipment" accordingly.

    (c) Reduces the 28 day restricted periods to 27 days.

A regulatory appraisal has not been prepared for this Order.

In relation to Wales, the functions of "the Ministers" so far as exercisable by the Secretary of State for Wales were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I.1999/672); and so far as exercisable by the Secretary of State for Scotland were transferred to the Minister of Agriculture, Fisheries and Food by the Transfer of Functions (Agriculture and Food) Order 1999, S.I. 1999/3141. All functions of the Minister of Agriculture, Fisheries and Food were then further transferred to the Secretary of State by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794).back
