The National Assembly for Wales makes the following Order in exercise of the powers conferred on it by sections 87 and 106(1)(b) of the Local Government Act 2000[1]. Name, commencement, application and interpretation 1. - (1) The name of this Order is the Local Government Elections (Wales) Order 2001 and it shall come into force on 15th November 2001. (2) This Order applies to county, county borough and community councils in Wales. (3) In this Order -
Postponement of ordinary elections (This note is not part of the Order) The National Assembly for Wales, may, under section 87 of the Local Government Act 2000, make provision which changes the years in which the ordinary elections of councillors of any specified local authority are to be held (without changing the prevailing scheme for the election of such councillors). This Order makes provision for modification of section 26(1) (Elections of Councillors) and section 35(2) (Community Councillors) of the Local Government Act 1972 so that elections of councillors to all county, county borough and community councils in Wales will be delayed by one year. The elections will take place in 2004 and in every fourth year thereafter. The term of office of existing councillors is accordingly extended by one year. Notes: [1] 2000 c.22.back
