HOUSING, WALES

The Housing Grants (Additional Purposes) (Wales) Order 2001

  Made 24th May 2001 
  Coming into force 1st July 2001 

The National Assembly for Wales makes the following Order in exercise of the powers conferred on the Secretary of State by sections 12(1)(i), 17(1)(j), 27(1)(j) and 146(2) of the Housing Grants, Construction and Regeneration Act 1996[1], which are now exercisable in relation to Wales by the National Assembly for Wales[2]:

Name, commencement and application
     1.  - (1) The name of this Order is the Housing Grants (Additional Purposes)(Wales) Order 2001 and it shall come into force on 1st July 2001.

    (2) This Order applies to Wales only.

    (3) This Order shall not have effect in relation to an application for a grant made before 1st July 2001.

Interpretation
    
2. In this Order, "the Act" means the Housing Grants, Construction and Regeneration Act 1996.

Renovation grants
    
3. For the purposes of section 12 of the Act (renovation grants: purposes for which grant may be given), an additional purpose specified is - to improve energy efficiency.

Common parts grants
    
4. For the purposes of section 17 of the Act (common parts grants: purposes for which grant may be given), an additional purpose specified is - to improve energy efficiency.

HMO (Houses in multiple occupation) grants
    
5. For the purposes of section 27 of the Act (HMO grants: purposes for which grant may be given), an additional purpose specified is - to improve energy efficiency.

EXPLANATORY NOTE

(This note does not form part of the Order)


Sections 12, 17 and 27 of the Housing Grants, Construction and Regeneration Act 1996 ("the 1996 Act") set out the purposes for which grants for the renewal of private sector housing may be given. The Secretary of State has the power under sections 12(1)(i), 17(1)(j) and 27(1)(j) to specify other purposes by order. This power is now exercisable in relation to Wales by the National Assembly for Wales.

This Order specifies an additional purpose for which a grant under sections 12 (renovation grants), 17 (common parts grants) and 27 (grants for houses in multiple occupation - HMO) of the 1996 Act may be given. The additional purpose is, in each case, to improve energy efficiency.
