The National Park Authorities Levies (Wales) (Amendment) Regulations 2001

  Made 15th February 2001 
  Coming into force 16th February 2001 

The National Assembly for Wales, in exercise of the powers conferred on the Secretary of State by sections 74, 140(4) and 143(2) of the Local Government Finance Act 1988 [1] and now vested in the National Assembly for Wales and of all other powers enabling it in that behalf, makes the following Regulations.

Citation commencement and interpretation
     1.  - (1) These Regulations may be cited as the National Park Authorities Levies (Wales) (Amendment) Regulations 2001 and shall come into force on 16th February 2001.

    (2) In these Regulations:

    "the 1996 Regulations" ("Rheoliadau 1996") means the National Park Authorities Levies (Wales) (Amendment) Regulations 1996 [3];

    "the 2000 Regulations" ("the 2000 Regulations") means the National Park Authorities Levies (Wales) (Amendment) Regulations 2000 [4].

Revocation of the 2000 Regulations
     2. The 2000 Regulations are hereby revoked.

Re-instatement of provisions of the Principal Regulations
    
3. The provisions of the Principal Regulations (as amended by the 1996 Regulations) shall have effect as they existed immediately prior to the 2000 Regulations coming into force.

Provision for the financial year which began in 2000
    
4. These Regulations do not affect the validity of anything done in accordance with the provisions of the 2000 Regulations in relation to any levy by a National Park authority for the financial year which began on 1 April 2000.

EXPLANATORY NOTE

(This note is not part of the Regulations)


The National Park Authorities (Levies) (Wales) Regulations 1995 ("the Principal Regulations") provide for the issue of levies by National Park Authorities to Welsh county or county borough councils as billing authorities for National Parks in Wales.

The Principal Regulations were amended by the National Park Authorities (Levies) (Wales) (Amendment) Regulations 1996 ("the 1996 Regulations").

Further amendments to the Principal Regulations were made by the National Park Authorities Levies (Wales) (Amendment) Regulations 2000 ("the 2000 Regulations").

The effect of the 2000 Regulations was:

    a) to revoke the provisions in the Principal Regulations (as amended by the 1996 Regulations) which prevented a National Park authority from issuing a levy before the 15 January in the financial year preceding the financial year to which the levy related, unless the National Assembly for Wales had made a determination of the amount of grant it was prepared to give the authority under section 72 of the Environment Act 1995;

    b) to revoke the provisions in the Principal Regulations which provided a formula for calculating the maximum amount of the levy which a National Park authority could issue;

    c) to fix the maximum amount of the levies which each National Park authority could issue in respect of the financial years beginning in 2000 and 2001.

The effect of these Regulations is to re-instate those provisions of the Principal Regulations (as amended by the 1996 Regulations) which were revoked by the 2000 Regulations but without affecting the provisions for the financial year which began in 2000.
