(a) part-time education to persons over compulsory school age only; or

(b) full-time education to persons who have attained the age of 19 years only; or

(c) both such part-time and full-time education.

    (3) In this regulation  - 

(a) "qualified teacher" has the same meaning as in section 218(2) of the Education Reform Act 1988[4];

(b) references to a person employed as a teacher include references to a person who is engaged to provide his or her services as a teacher otherwise than under a contract of employment; and

(c) references to a school are references:


(i) to a school maintained by a local education authority within the meaning of section 142(1) of the School Standards and Framework Act 1998[5]; or

(ii) to a special school within the meaning of section 337(1) of the Education Act 1996[6] which is not so maintained.
