Signed on behalf of the National Assembly for Wales under section 66(1) of the Government of Wales Act 1998 [4]. Jane Davidson The Deputy Presiding Officer of the National Assembly 7th July 2000 (This note does not form part of the Regulations) The Community Care (Direct Payments) Act 1996 enables a local authority responsible for providing (or arranging provision of) community care services to make contributions by way of direct payments to persons so that they may secure the provision of such services. The Community Care (Direct Payments) Regulations 1997 specify the persons to whom direct payments may be made under the Act. The description of such persons excludes any person who is aged 65 or over, unless that person received a direct payment in the year before attaining the age of 65. These Regulations amend the 1997 Regulations so that the persons to whom direct payments may be made under the Act include persons aged 65 or over irrespective of whether they received such a payment in the year before attaining the age of 65. Notes: [1] 1996 c. 30.back [2] The functions of the Secretary of State under the Community Care (Direct Payments) Act 1996 were transferred to the National Assembly for Wales by the National Assembly for Wales (Transfer of Functions) Order 1999 (SI 1999/672).back
