In exercise of powers conferred on Ministers of the Crown by sections 6(4), 16(1)(a) and (e), 17(1), 26(1) and (3) and 48(1) of, and paragraph 1 of Schedule 1 to, the Food Safety Act 1990[1], and now vested in the National Assembly for Wales[2], after having regard in accordance with section 48 (4A) of that Act to relevant advice given by the Food Standards Agency and after consultation in accordance with section 48(4) and (4B) of that Act with such organisations as appear to it to be representative of interests likely to be substantially affected by the following Regulations, the National Assembly for Wales makes the following Regulations: Citation, commencement, application and interpretation 1. - (1) These Regulations may be cited as the Colours in Food (Amendment) (Wales) Regulations 2000, shall come into force on 8th July 2000 and shall apply to Wales. (2) In these Regulations "the principal Regulations" ("y prif Reoliadau") means the Colours in Food Regulations 1995[3]. Amendment of the principal Regulations 2.- The principal Regulations, in so far as they apply to Wales, shall be amended by the addition, at the end of the definition of "Directive 95/45/EC" in regulation 2(1), of the words", as amended by Directive 1999/75/EC"[4]. Consequential provision 3. - (1) References to the principal Regulations in the provisions listed in paragraph (2) below shall, in so far as those provisions apply to Wales, be taken to be references to the principal Regulations as amended by these Regulations. (2) The provisions to which paragraph (1) above refers are -
(b) the definition of "additive" in regulation 2(1) (interpretation) of the Meat Products and Spreadable Fish Products Regulations 1984[6]; (c) the definition of "colour" in Part II of Schedule 1 (categories of food additives) to the Food Additive Labelling Regulations 1992([7] (d) the definition of "colour" in regulation 2(1) (interpretation) of the Miscellaneous Food Additives Regulations 1995[8]; and (e) the definition of "the additives Regulations" in regulation 2(1) (interpretation) of the Food Labelling Regulations 1996[9].
(This note is not part of the Regulations) These Regulations, which apply only to Wales, amend the Colours in Food Regulations 1995 ("the 1995 Regulations") by bringing up to date a reference to Commission Directive 95/45/EC laying down specific criteria concerning colours for use in foodstuffs (0J No. L226, 22.9.95, p.1), so as to cover its amendment by Commission Directive 1999/75/EC (OJ No. L206, 5.8.1999, p.19) which changed the specification for "E160a(i) Mixed Carotenes", and by bringing up to date references to the 1995 Regulations in other Regulations. The 1995 Regulations specify the circumstances in which colours (defined as being food additives which are used or intended to be used for the primary purpose of adding or restoring colouring in food) are permitted to be used or sold. Any colour can only be so permitted if it satisfies the purity criteria specified in Commission Directive 95/45/EC.
