The Scottish Ministers make the following Order in exercise of the powers conferred by section 174 of the Housing (Scotland) Act 2006(1) and all other powers enabling them to do so.
1. This Order may be cited as the Housing (Scotland) Act 2006 (Repayment Charge and Discharge) Order 2007 and comes into force on 8th October 2007.
2. A repayment charge must be in the form set out in Schedule 1 or as close to it as circumstances permit.
3. A discharge of a repayment charge must be in the form set out in Schedule 2 or as close to it as circumstances permit.

The Schedules to this Order set out the form of a repayment charge and the form of a discharge of a repayment charge which can be made by a local authority under Part 7 of the Housing (Scotland) Act 2006.
A local authority is entitled to make a repayment charge to recover a sum under section 59(1) or (2) of, or paragraph 6(1) of schedule 5 to that Act.
