The Scottish Ministers, in exercise of the powers conferred by section 40(4) of the Fire (Scotland) Act 2005[1], and of all other powers enabling them in that behalf, and after consulting each relevant authority or such persons as they consider represent those authorities and such persons as they consider represent employees of those authorities in accordance with section 40(5) of that Act, hereby make the following Order: Citation and commencement 1. This Order may be cited as the Fire and Rescue Services (Framework) (Scotland) Order 2005 and shall come into force on 6th October 2005. The Fire and Rescue Framework 2. For the purposes of section 40(4) of the Fire (Scotland) Act 2005, the Fire and Rescue Framework prepared by the Scottish Ministers and entitled "The Fire and Rescue Framework for Scotland 2005" published by the Scottish Executive in October 2005[2] shall have effect. HUGH HENRY Authorised to sign by the Scottish Ministers St Andrew's House, Edinburgh 13th September 2005 (This note is not part of the Order) Section 40 of the Fire (Scotland) Act 2005 ("the Act") requires the Scottish Ministers to prepare a document, which must set out priorities and objectives for relevant authorities in connection with the carrying out of their functions and may contain related guidance and such other matters relating to those authorities or those functions. Under section 41(1) of the Act, relevant authorities must have regard to the document in carrying out their functions. Section 40(4) of the Act provides that the document has effect only when brought into effect by the Scottish Ministers by order. Article 2 of this Order gives effect on 6th October 2005 to the document prepared by the Scottish Ministers and entitled The Fire and Rescue Framework for Scotland 2005.
