The Scottish Ministers, in exercise of the powers conferred by section 2 of the Fireworks Act 2003[1] and of all other powers enabling them in that behalf, and having consulted the Health and Safety Commission, those organisations which appear to them to be representative of interests substantially affected by these Regulations and such other persons whom they consider it appropriate to consult, hereby make the following Regulations: Citation, commencement and extent 1. - (1) These Regulations may be cited as the Fireworks (Scotland) Amendment Regulations 2005 and shall come into force on 1st June 2005. (2) These Regulations extend to Scotland only. Amendment of the Fireworks (Scotland) Regulations 2004 2. - (1) The Fireworks (Scotland) Regulations 2004[2] shall be amended as follows. (2) In regulation 4 (dispensation from the prohibition imposed by regulation 3)-
(b) for paragraph (2), substitute-
(This note is not part of the Regulations) These Regulations amend the Fireworks (Scotland) Regulations 2004 (S.S.I. 2004/393) ("the principal Regulations"). Regulation 2 amends Regulation 4 of the principal Regulations by removing the references to government and armed forces employees. The Crown is not bound by these Regulations. Notes: [1] 2003 c.22. By virtue of article 4 and the Schedule to The Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 2004 (S.I. 2004/2030), the Scottish Ministers exercise the functions concurrently with the Secretary of State for Trade and Industry, being functions conferred by section 2 of the Fireworks Act 2003.back
