The Scottish Ministers, in exercise of the powers conferred by section 330 of the Housing (Scotland) Act 1987[1] and of all other powers enabling them in that behalf, hereby make the following Regulations: Citation, commencement and revocation 1. - (1) These Regulations may be cited as the Housing Grants (Form of Cessation or Partial Cessation of Conditions Notice) (Scotland) Regulations 2003 and shall come into force on 1st October 2003. (2) Form 6 as set out in the Schedule to the Housing (Forms) Scotland Regulations 1980[2] is hereby revoked. Form of Notice of Cessation of Conditions 2. The form of the notice contained in the Schedule to these Regulations is hereby prescribed as the form of notice to be used for the purposes of paragraph 6(2) of Schedule 19 to the Housing (Scotland) Act 1987. A notice of payment of [improvement grant] [repairs grant] [grant for means of escape from fire for a house in multiple occupation] amounting to [£ ] paid to [name] in respect of works carried out on the house at [address or other description of the property] was [recorded in the Division of the General Register of Sasines applicable to the County of [County] on [date]]/[registered in the Land Register of Scotland under Title Number [ ] on [date]]. That notice stated that certain conditions must be observed with respect to the said house. 2. In accordance with paragraphs 4 and 6 of Schedule 19 of the Housing (Scotland) Act 1987 the said notice of payment is no longer required [in full/partially] in respect of the said house. Therefore [name and designation of local authority] hereby confirm that, as from [date of cessation of conditions], [all the conditions]/[conditions [ ]] in the said notice no longer apply to the said house. Signed Date (This note is not part of the Regulations) These Regulations prescribe the form of notice that is to be used by a local authority where the conditions, or some of the conditions, that apply where the local authority have provided payment of an improvement or repairs grant or a grant for means of escape from fire for a house in multiple occupation cease to apply. The Schedule to the Regulations sets out the form of the notice to be recorded in the General Register of Sasines or registered in the Land Register. The Regulations revoke the existing form of notice which is Form 6 as set out in the Schedule to the Housing (Forms) Scotland Regulations 1980. Notes: [1] 1987 c.26.
