The Pigs (Records, Identification and Movement) (Scotland) Amendment Order 2002

  Coming into force 31st December 2002 

The Scottish Ministers, in exercise of the powers conferred by sections 1, 8(1) and 83(2) of the Animal Health Act 1981[1] and of all other powers enabling them in that behalf, hereby make the following Order:

Citation, commencement and extent
     1.  - (1) This Order may be cited as the Pigs (Records, Identification and Movement) (Scotland) Amendment Order 2002 and shall come into force on 31st December 2002.

    (2) This Order extends to Scotland only.

Amendment of the Pigs (Records, Identification and Movement) Order 1995
    
2.  - (1) The Pigs (Records, Identification and Movement) Order 1995[2] is amended in accordance with the following paragraphs of this article.

    (2) In article 8(2)(a)(ii) omit "or 10".

    (3) In article 12(1) omit ", 10".

    (4) In article 16(a) omit "paragraph (2) of article 10,".

    (5) Article 10 and Schedule 5 are revoked.

    (6) In article 15(1) add after "declaration", in each case where it appears, "or licence".

    (7) In condition 5 of Schedule 2 and condition 5 of Schedule 6[3] in each case omit "unless the pigs are to be moved for immediate slaughter".

    (8) In Schedule 7-

    (a) in the heading omit ", 10";

    (b) after "An inspector for the purposes of the Animal Health Act 1981" add

    " Countersignature

    [Name in block letters]

    Person to whom the licence is granted";

    (c) in condition 3, for "declaration" substitute "licence"; and

    (d) add at the end the following condition:-

         " 6. The person to whom the licence is granted must within 3 days of the movement of the pigs countersign the licence, and send the countersigned licence to the Local Authority for the place from which the pigs have been moved.".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order, which extends to Scotland only, implements Council Directive 2000/15/EC amending Council Directive 64/432/EEC on health problems affecting intra Community trade in bovine animals and swine.

The Order amends the Pigs (Records, Identification and Movement) Order 1995 ("the principal Order") by providing revised versions of the declarations to accompany movements of pigs in accordance with article 9 of and Schedule 2 to, and article 11 of and Schedule 6 to, the principal Order, so that such declarations must be sent to the appropriate local authority even if the pigs are being moved for immediate slaughter. The Order revokes article 10 of and Schedule 5 to the principal Order dealing with movement of pigs from waste food premises. The Order also makes revisals to the movement licence issued in accordance with article 12 of and Schedule 7 to the principal Order so that the licence must be countersigned by the licensee and sent to the local authority within 3 days of the movement.

A breach of the terms of the principal Order or of a licence issued thereunder constitutes an offence under the Animal Health Act 1981.

A Regulatory Impact Assessment has not been prepared for this Order.
