The Disease Control (Interim Measures) (Scotland) Amendment (No. 2) Order 2002

  Coming into force 1st January 2003 

The Scottish Ministers, in exercise of the powers conferred upon them by sections 1, 7 and 8(1) of the Animal Health Act 1981[1], and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and commencement
     1. This Order may be cited as the Disease Control (Interim Measures) (Scotland) Amendment (No. 2) Order 2002 and shall come into force on 1st January 2003.

Amendments to the Disease Control (Interim Measures) (Scotland) Order 2002
    
2.  - (1) The Disease Control (Interim Measures) (Scotland) Order 2002[2] is amended in accordance with the following provisions of this article.

    (2) In article 4 (specific exemptions)-

    (a) in paragraph (f) for ", ram or billy goat" substitute "or ram"; and

    (b) after paragraph (q) insert-

      " (r) movement of any animal by virtue only of the fact that it comes from premises onto which a goat of either sex has been brought for breeding purposes provided that it is intended to be used for those purposes shortly after being so brought on;

      (s) movement of any animal by virtue only of the fact that it comes from premises to which a goat of either sex has been returned after being moved in accordance with paragraph (r)".

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Disease Control (Interim Measures) (Scotland) Order 2002 ("the principal Order"). It amends the 20 day standstill on the movement of animals which is contained in articles 3 to 5 of the principal Order, relative to breeding goats. It will allow breeding goats of either sex to move onto a holding for breeding purposes without triggering a 20 day standstill on that holding, and to return to their holding of origin without triggering a 20 day standstill.

This Order will require the making of consequential amendments to articles 6 and 13 of the Sheep and Goats Identification (Scotland) Regulations 2000.

A breach of the terms of the principal Order or of a licence issued thereunder constitutes an offence under the Animal Health Act 1981.

A Regulatory Impact Assessment has not been prepared for this Order.
