The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972[1] and of all other powers enabling them in that behalf, hereby make the following Regulations: Citation, commencement and extent 1. - (1) These Regulations may be cited as the Welfare of Animals (Slaughter or Killing) Amendment (Scotland) Regulations 2002 and shall come into force on 10th June 2002. (2) These Regulations extend to Scotland only. Amendment to the Welfare of Animals (Slaughter or Killing) Regulations 1995 2. - (1) Schedule 7 to the Welfare of Animals (Slaughter or Killing) Regulations 1995[2] is amended in accordance with the following paragraphs. (2) For paragraph 7(2) there is substituted-
(b) any mixture of argon, nitrogen, or other inert gases with atmospheric air and carbon dioxide, provided that the carbon dioxide concentration does not exceed 30% by volume and the oxygen concentration does not exceed 2% by volume.".
(3) In paragraph 8(c)(iii)(bb) omit "falls below 25% or". (This note is not part of the Regulations) These Regulations amend the Welfare of Animals (Slaughter or Killing) Regulations 1995 ("the principal Regulations") which gave effect to Council Directive 93/119/EC on the protection of animals at the time of slaughter or killing (O.J. No. L 340, 31.12.93, p.21). These Regulations substitute a new paragraph 7(2) of Schedule 7 to the principal Regulations, so as to permit a new gas mixture for killing birds at the slaughterhouse. They also make consequential amendments to paragraphs 8 and 10 of that Schedule. No Regulatory Impact Assessment has been prepared in relation to these Regulations.
